NEWSLETTER TERMS AND CONDITIONS

§1 General provisions

  1. These Terms and Conditions define the rules for providing the newsletter service by SMF TECHNOLOGY POLAND SPÓŁKA Z OGRANICZONĄ ODPOWIEDZIALNOŚCIĄ, with its registered office at ul. Elektryczna 14–16, 21‑045 Świdnik, Poland, NIP: 7123230267, REGON: 06069304800000 (hereinafter referred to as the “Administrator”).
  2. The Newsletter service consists of sending subscribed users (hereinafter referred to as the “Users”), via electronic mail, commercial, marketing, industry‑related, informational and other content prepared or distributed by the Administrator (hereinafter referred to as the “Newsletter”).
  3. The Newsletter service is provided via the Administrator’s website available at https://smfgmbh.com/ (hereinafter referred to as the “Website”).
  4. The Newsletter service is provided free of charge for an indefinite period of time.

§2 Registration and use of the Newsletter service

  1. Registration for the Newsletter service constitutes acceptance of these Terms and Conditions and the Privacy Policy available on the Website (hereinafter referred to as the “Privacy Policy”).
  2. In order to subscribe to the Newsletter service, the User must:
    1. complete the subscription form available on the Website by providing an e‑mail address;
    2. accept these Terms and Conditions and the Privacy Policy;
    3. give consent to receive the Newsletter as commercial information defined by provisions of applicable law;
    4. confirm the subscription (e.g. by clicking the activation link or the “Subscribe” button).
  1. Granting the consent referred to above is voluntary; however, it is necessary for the provision of the Newsletter service. Failure to grant consent will prevent the provision of the service.
  1. Upon effective registration, the User’s e‑mail address will be added to the Administrator’s mailing list and used solely for the purpose of sending the Newsletter.
  1. In order to use the Newsletter service, the User must have:
    1. a device with Internet access (e.g. a computer, laptop, tablet or smartphone);
    2. an active e‑mail account.
  1. The Administrator does not provide the devices, software or Internet access required to use the Newsletter service.
  1. The User may unsubscribe from the Newsletter service at any time and without giving any reason by:
    1. sending a relevant request to the Administrator’s email address: [wstawić];
    2. submitting a written resignation to the Administrator’s registered office address.
  1. The User may also unsubscribe from the Newsletter service at any time by clicking the unsubscribe link included in the footer of each Newsletter message.
  2. The Administrator reserves the right to discontinue the Newsletter service at any time. Users will be informed of such discontinuation by e‑mail.

§3 Rules for using the Newsletter service

  1. The User is obliged to provide true and up‑to‑date data when registering for the Newsletter service.
  1. The User undertakes to use the Newsletter service in accordance with applicable law and the provisions of these Terms and Conditions.
  1. It is prohibited to undertake any actions that could disrupt the functioning of the Newsletter service or the Website, in particular interference with their technical structure.
  1. The Administrator is entitled to change the scope, form or frequency of the Newsletter, as well as to temporarily or permanently discontinue the service.
  2. The content of the Newsletter is protected by copyright and other intellectual property rights belonging to the Administrator or third parties.

§4 Complaints

  1. Complaints regarding the Newsletter service may be submitted:
    1. in writing to the Administrator’s registered office address;
    2. electronically to the email address: admin@smfgmbh.com.
  1. It is recommended that a complaint include a description of the issue, the User’s request and contact details; however, failure to include these elements does not affect the validity of the complaint.
  1. The Administrator shall consider the complaint within 14 days of its receipt and inform the User of the outcome.

§5 Personal data

  1. The Users’ personal data are processed by the Administrator in accordance with applicable law, in particular Regulation (EU) 2016/679 (GDPR).
  2. Providing personal data is voluntary but necessary for the provision of the Newsletter service.
  3. The User has the right to access their personal data, rectify them, erase them, restrict their processing and exercise other rights provided for by law.
  4. Detailed information regarding the processing of personal data is included in the Privacy Policy.

§6 Amendments to the Terms and Conditions

  1. The Administrator reserves the right to amend these Terms and Conditions for important reasons, in particular in the event of changes in legal regulations, the functionality of the service or the Administrator’s details.
  2. Users will be informed of any amendments to the Terms and Conditions by e‑mail.
  3. Failure to accept the amended Terms and Conditions shall be tantamount to resignation from the Newsletter service.

§7 Governing law and dispute resolution

  1. The governing law for the agreement on the provision of the Newsletter service is Polish law.
  2. Any disputes arising from the use of the Newsletter service shall be resolved  in accordance with applicable law.
  3. A User who is a consumer may use out‑of‑court dispute resolution methods, including the EU online dispute resolution (ODR) platform.

§8 Final provisions

  1. In matters not regulated by these Terms and Conditions, the applicable law provisions shall apply.
